COVID-19: Extension for Final Term Limit Suspensions for Industrial Property Applications

As per Provisional Article 1 of the Law Amending Certain Acts numbered 7226 (“Law No. 7226”) published in the repeating Official Gazette No. 31080 dated March 26, 2020, compulsory administrative application periods, including final term limits, regarding the origination, use or termination of a right have been suspended from 13 March 2020.

The Regulation included term limits stated under the Industrial Property Act numbered 6769 (“Law No. 6769”).

As per the authorization given by Law No.7226 Article 1(1), the Presidential Decree dated 29 April 2020 and numbered 2480, all suspensions were prolonged until 15 June 2020 (including the date).

The application periods, stated under the Law No.6769 will therefore be implemented as follows; i) Application deadlines, which will be on 12 March 2020 or before provided by the Turkish Patent and Trademark Office (“TPTO”) remain unchanged; ii)  Application deadlines between 13 March 2020 to 27 March 2020 (including the specified dates) has been prolonged till 30 June; iii)  Application deadlines between 28 March 2020 to 15 June 2020 (including the specified dates) will be added, as remaining time, to 16 June 2020 for prolonging the application (starting from 13 March 2020); iv) Application term limits provided by TPTO  for applications before 13 March 2020 and with a deadline on 16 June 2020 or afterwards will be given additional 95 days for final date; v) Application term limits provided by TPTO  for applications between 13 March 2020 to 15 June 2020 (including the specified dates) will begin on 16 June 2020.
