OFAC’ten Whitford’un Türkiye ve İtalya İştirakleri İşlemleri İçin İhlal Kararı

Amerika Birleşik Devletleri Hazine Bakanlığı Yabancı Varlıkları Kontrol Ofisi (“OFAC”), 28 Temmuz 2020 tarihinde Whitford Worldwide Company’nin (“Whitford”) Türkiye’de ve İtalya’da bulunan iştiraklerinin (“Whitford Türkiye” ve “Whitford İtalya”) ABD’nin İran yaptırım düzenlemesini ihlal etmesinden dolayı, Whitford ile 824.314,00 Amerikan Doları (“USD”) değerinde bir uzlaşma anlaşması imzalandığını açıkladı.

EU-US Privacy Shield Ending: Future Strategies

On July 16, 2020, the long awaited landmark decision of Court of Justice of the European Union (“Court”) on the validity of the controller to processor standard contractual clauses (European Commission Decision 2010/87/EU dated February 5, 2010) and the EU-U.S. Privacy Shield (European Commission Decision 2016/1250 dated 12 July 2016) was published on the website of the Court. Accordingly, the EU-U.S. Privacy Shield is invalidated and cannot be used as an instrument of a data transfer between European Union (“EU”) and United States (“U.S.”).

An Alert for Foreign Data Controllers in Turkey

On July 10, 2020 Turkish Personal Data Protection Board (“Board”) published summary of its decision numbered 2020/471 and dated June 23, 2020 (“Decision No. 2020/471”) stating that foreign companies who have representative offices in Turkey and proceed its data processing activities outside of Turkey may be subject to the Law on the Protection of Personal Data No. 6698 (“Law No. 6698”) and the obligation to register in the Data Controllers Registry Information System (“VERBIS”).
