Turkish Public Procurement Authority (“Procurement Authority”) has been adding certain specifications on electronic tender (“e-tender”) systems in order to extend the use of e- tendering, especially in order to facilitate tenders with the spread of Covid-19. In this respect, many specifications have been added in terms of open tender procedure.

The nature and characteristics of the information in defense projects have implications for how contractors should manage export activities that go far beyond confidentiality commitments. On April 17, 2020 a new provisional article was added to Turkish Commercial Code numbered 6102 (“TCC”) regarding the prohibition of dividend distribution for capital companies (excluding public legal entities and their affiliates) for the portion exceeding twenty-five percent of the net profit for the fiscal year 2019 until September 30, 2020.
