COVID-19: Recent Regulatory Updates in Turkey

Several presidential decrees have been promulgated on the Official Gazette numbered 31322 dated December 2, 2020, amending the standards of short-term working and premium support practices as measures to pandemic. As per the newly in effect Presidential Decree numbered 3246, short-time working payment period is extended for six additional months to the short-time working period determined under the Presidential Decree numbered 3134 published in the Official Gazette numbered 31287 dated October 27, 2020. With this respect, short-time working payment is extended until the end of June 2021.

According to the Presidential Decree numbered 3248 published in the Official Gazette dated December 2, 2020, the period of premium support provided to the employers is extended for two years. With this regard, employers are entitled to benefit from premium support until the end of December 2022.

Again, following to the Presidential Decree numbered 3247 published in the Official Gazette dated December 2, 2020, the calculated amount of the employees’ insurance premiums belonging to the employers’ shares are supported (‘employee insurance premium support’) until the end of December 2022. With this regard, workplaces who intend to benefit from the employee insurance premium support must ensure that they belong to private sector employers, submit monthly premium and service documents to Turkish Employment Agency within due period and the conditions for the payment of the accrued insurance premiums within due period must have been fulfilled together. Yet, employees of the workplaces that intend to benefit from the employee insurance premium support also must meet with certain conditions.

Accordingly, employees must have been employed between the dates of March 1, 2011 and December 31, 2015, must be older than age 18, working de facto and not being registered in the monthly premium and service documents submitted to the Turkish Employment Agency in the six-month period before the date of employment.
