With the recent Presidential Decree numbered 4082 and dated June 5, 2021, Turkey has blocked assets and accounts of three new individuals namely, Idrees Ali Awad ALFAY, Ibrahim Ali Awad ALFAY and Mohammad Alaa KHANFORAH, and an enterprise called Alfay İnşaat Turizm Dış Ticaret Sanayi Ltd.
Background
United Nations Security Council’s (“UNSC”) resolution numbered 1373 (2001) were adopted to highlight the threats to international peace and security caused by terrorist acts, and in particular to reaffirm terrorist attacks which took place in New York, Washington, D.C. and Pennsylvania on September 11, 2001. This Resolution numbered 1373 (2001) encouraged member states to work together urgently to prevent and suppress terrorist acts, including through increased cooperation and full implementation of the relevant international conventions relating to terrorism.
Referring to the said resolution of UNSC, Turkey has decided to block assets and accounts of those individuals and the enterprise, in terms of their support and sponsorship, providing financial, material or technological support and providing other financial or non-financial services to a terrorist organization. Accordingly, these target individuals and officials of the said enterprise may file a lawsuit before the Council of State within 60 days against the blocking decision in the Presidential Decree.
