A new regulation amending the Regulation on the Rights of the Passengers Traveling by Airline (“Regulation”) was published in the Official Gazette No. 31079 dated March 25, 2020.
Accordingly, if the flight is canceled as of February 5, 2020 due to the COVID-19 pandemic; the air transport operator that executed or committed to the flight is exempted from the provisions in the 8th, 9th and 10th articles of the Regulation related to compensation or services to be given to passengers in case of cancellation or delay of flights until the end of the two months after the flight bans are lifted.
In addition, the passenger whose flight is canceled, due to COVID-19, has the right to reschedule its flight to a future date, depending on the air operator’s seat availability or alternatively, passengers will be able to receive the refund of the unused ticket from the airline operator two months after the flight bans are lifted.
