Bunlar\u0131n kaynaklar\u0131 nelerdir?<\/strong><\/p>\n<p style=\"text-align:justify\">T\u00fcrk mevzuat\u0131nda \u00f6zel sekt\u00f6re ili\u015fkin ba\u011flay\u0131c\u0131 bir ikramiye ve\/veya prim d\u00fczenlemesi bulunmamaktad\u0131r, dolay\u0131s\u0131yla bunlar\u0131n uygulanmas\u0131 i\u015fverenlerin takdirine ba\u011fl\u0131d\u0131r. Sonu\u00e7 olarak, primler ve ikramiyeler \u00e7o\u011funlukla i\u015f s\u00f6zle\u015fmelerinden, toplu s\u00f6zle\u015fmelerden veya \u015firketin i\u00e7 d\u00fczenlemelerinden kaynaklanmaktad\u0131r.<\/p>\n<p style=\"text-align:justify\">Prim, nitelik ve nicelik a\u00e7\u0131s\u0131ndan ba\u015far\u0131l\u0131 performansa kar\u015f\u0131l\u0131k olarak \u00e7al\u0131\u015fana \u00f6denen ek bir \u00f6demedir<a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a>. \u00d6te yandan, ikramiye, olumlu bir i\u015fveren-\u00e7al\u0131\u015fan ili\u015fkisi yaratmak veya \u00f6rne\u011fin yeni y\u0131l, ulusal veya dini bir bayram, evlilik, do\u011fum, i\u015fletmenin kurulu\u015f y\u0131ld\u00f6n\u00fcm\u00fc gibi \u00f6zel bir durumu kutlamak i\u00e7in \u00e7al\u0131\u015fana sa\u011flanan ek bir \u00f6deme olarak tan\u0131mlanabilir.<a href=\"#_ftn2\" name=\"_ftnref2\">[2]<\/a><\/p>\n<p style=\"text-align:justify\">Ki\u015fisel performansa dayal\u0131 oldu\u011fu i\u00e7in, bir \u00e7al\u0131\u015fan bu t\u00fcr bir ek \u00f6deme i\u00e7in belirlenen ko\u015fullar\u0131 yerine getirdi\u011finde prim almaya hak kazan\u0131r. Primler d\u0131\u015f\u0131nda, \u00e7al\u0131\u015fanlardan herhangi birinin ikramiye almas\u0131 halinde, ikramiyenin genel bir uygulama olmas\u0131 nedeniyle, ayr\u0131m yap\u0131lmas\u0131n\u0131 gerektirecek ge\u00e7erli bir neden olmad\u0131k\u00e7a, e\u015fit muamele ilkesine uygun olarak t\u00fcm \u00e7al\u0131\u015fanlar\u0131n ikramiyeden yararlanmas\u0131 gerekmektedir. Primler ve ikramiyeler, \u00e7al\u0131\u015fan\u0131n k\u0131dem ve ihbar tazminat\u0131 hesaplan\u0131rken dikkate al\u0131nd\u0131klar\u0131 i\u00e7in de \u00f6nemlidir.<\/p>\n<p style=\"text-align:justify\">Aksi takdirde, \u00e7al\u0131\u015fan ge\u00e7erli nedenle fesih hakk\u0131n\u0131 kullanabilir ve tazminat i\u00e7in i\u015f mahkemelerine ba\u015fvurabilir. Hukuk Dairesi'nin de belirtti\u011fi gibi<sup>inci<\/sup> Hukuk Dairesi'nin 15\/01\/2013 tarih ve 2012\/30916-2013\/568 say\u0131l\u0131 karar\u0131 ile prim ve ikramiyelerin \u00fccretin eki niteli\u011finde oldu\u011fu kabul edilerek bunlar hakk\u0131nda da bu yola ba\u015fvurulabilece\u011fi belirtilmi\u015ftir.<\/p>\n<p style=\"text-align:justify\"><strong>Primler ve\/veya ikramiyeler ne zaman zorunlu hale gelir?<\/strong><\/p>\n<p style=\"text-align:justify\">Prim ve\/veya ikramiyelerin i\u015f s\u00f6zle\u015fmesi veya toplu i\u015f s\u00f6zle\u015fmesi kapsam\u0131nda bir y\u00fck\u00fcml\u00fcl\u00fck olarak d\u00fczenlenmesi halinde i\u015fverenin y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc olmas\u0131 do\u011fal bir sonu\u00e7tur. Bir prim ve\/veya ikramiyenin, i\u015fveren taraf\u0131ndan tek tarafl\u0131 olarak uyguland\u0131\u011f\u0131nda dahi '<em>i\u015fyeri uygulamas\u0131<\/em>'.<\/p>\n<p style=\"text-align:justify\">Her \u015feyden \u00f6nce, i\u015fyeri uygulamas\u0131 yayg\u0131n bir uygulama olmal\u0131d\u0131r.
